class=\"slideshow-description\">\n\t\t\t\t\t<\/div>\n\t\n<\/div><\/div><!--#slideshow-wrapper-->\n<p>Fifty-seven years ago today, the Supreme Court rendered its decision in <em>Roth v. United States<\/em>, the preeminent obscenity case of the time. That <em>Roth<\/em> isn\u2019t Philip\u2014not that he\u2019s any slouch when it comes to indecency\u2014but Samuel, a widely reviled publisher perhaps most remembered today <a href=\"https:\/\/www.theparisreview.org\/blog\/2014\/05\/01\/i-did-not-approve-this-message\/\" target=\"_blank\">for bootlegging portions of <em>Ulysses<\/em><\/a>. As Michael Bronsky described him <a href=\"http:\/\/www.bostonphoenix.com\/boston\/news_features\/other_stories\/multi-page\/documents\/02397917.htm\" target=\"_blank\">in a piece for the <em>Boston Phoenix<\/em><\/a>,<\/p>\n<blockquote>\n<p>Roth became so notorious as both literary pirate and smuthound (the word in use at the time) that he was attacked in\u00a0<em>The<\/em><em> Nation<\/em> and <em>The New Yorker<\/em> as a literary fake and social nuisance. <em>Vanity Fair<\/em> included him, along with the up-and-coming Adolf Hitler, in its 1932 photo essay titled \u201cWe Nominate for Oblivion.\u201d<\/p>\n<\/blockquote>\n<p>In the course of his long and thoroughly ribald career, Roth often found himself dragged to court\u2014this particular case saw him violating a federal statute that banned the transmission of \u201cobscene, lewd, lascivious, or filthy\u201d materials using the postal service. Roth had been doing just that: his magazine <em>American Aphrodite<\/em> (\u201cA Quarterly for the Fancy-Free,\u201d the covers of later editions said) was the finest in literary smut. (And trust us: <em>The Paris Review<\/em> knows a thing or two about literary smut.) <!--more--><\/p>\n<p>Impressively\u2014and perhaps profligately\u2014<em>American Aphrodite <\/em>was a clothbound publication; take a look at the covers above to get a sense of its tenor. The titles of the work Roth published are by turns gently titillating (\u201cThe Willing Maid a Day Too Young,\u201d \u201cA Lover Without Knowing It,\u201d \u201cTake It Off! Take It Off!\u201d), ridiculously frank (\u201cGallery of Big Women in the Nude,\u201d \u201cJapanese Ladies Taking Their Bath\u201d), or simply bizarre (\u201cThe Two-Thousand Pound Raspberry,\u201d \u201cShake Your Goat-Leg,\u201d and a four-part series called \u201cThe Women of Plentipunda\u201d). Bronsky writes,<\/p>\n<blockquote>\n<p><em>American Aphrodite<\/em> usually featured things like mild erotic line drawings, some piece of long-out-of-print British literature (the \u201cscandalous\u201d seventeenth-century plays of Aphra Behn appear in many issues), a \u201cbawdy\u201d new translation from Chaucer, and something truly shocking, like nude photos of ten-year-old girls taken in Victorian brothels.<\/p>\n<\/blockquote>\n<p>And in his 2013 book, <em>Without Copyrights: Piracy, Publishing, and the Public Domain<\/em>, Robert Spoo explains that the magazine<\/p>\n<blockquote>\n<p>contained a typical Rothian stew of slightly dated literature and winking erotica, though some of the material, such as Aubrey Beardsley\u2019s unfinished novel <em>Venus and Tannh\u00e4user<\/em>, contained stronger sexual content. Woodcuts and drawings of thinly clad or nude women adorned the quarterly\u2019s pages, along with frank poems, such as one inquiring of God whether it is wrong to desire \u201cTwo women in one affection, \/ Two vulvas, four breasts\u201d \u2026 Roth\u2019s editorials chided \u201cMadame Post Office\u201d and other official powers for repressing \u201cour rights as American citizens engaged in interpreting the cultural and emotional motives of our time.\u201d<\/p>\n<\/blockquote>\n<p>For better or worse, that repression continued with <em>Roth v. United States<\/em>, in which a six-person majority submitted that obscene material wasn\u2019t protected by the First Amendment, and that said material could be defined as that whose \u201cdominant theme taken as a whole appeals to the prurient interest [to the] average person, applying contemporary community standards.\u201d The court maintained that Congress could ban any material fitting this definition; it upheld Roth\u2019s conviction, and he went to prison. The verdict held until 1973, when it was superseded by <em>Miller v.
